January 2, 2009 Barring a reprieve, regulations set to take effect next month could force thousands of clothing retailers and thrift stores to throw away trunkloads of children's clothing.

The law, aimed at keeping lead-filled merchandise away from children, mandates that all products sold for those age 12 and younger -- including clothing -- be tested for lead and phthalates, which are chemicals used to make plastics more pliable. Those that haven't been tested will be considered hazardous, regardless of whether they actually contain lead.

"They'll all have to go to the landfill," said Adele Meyer, executive director of the National Assn. of Resale and Thrift Shops.

The new regulations take effect Feb. 10 under the Consumer Product Safety Improvement Act, which was passed by Congress last year in response to widespread recalls of products that posed a threat to children, including toys made with lead or lead-based paint.

Supporters say the measure is sorely needed. One health advocacy group said it found high levels of lead in dozens of products purchased around the country, including children's jewelry, backpacks and ponchos.

Lead can also be found in buttons or charms on clothing and on appliques that have been added to fabric, said Charles Margulis, communications director for the Center for Environmental Health in Oakland. A child in Minnesota died a few years ago after swallowing a lead charm on his sneaker, he said.

But others say the measure was written too broadly. Among the most vocal critics to emerge in recent weeks are U.S.-based makers of handcrafted toys and handmade clothes, as well as thrift and consignment shops that sell children's clothing. The Story Doesn't say it, but this also covers Flea Markets, Garage Sales and anywhere people sell kids stuff used or new...... Well there went one Freedom, the Freedom to sell my kids clothes to a Resale shop...that is unless I am rich enough to get it tested first..which costs more than the Clothes are worth.......

Gee that law is kind of strict......... All China does is put to death those that put bad chemicals in the exports........

Our lawmakers should be held accounable for letting this crap enter our country in the first place......

we already pay to much for our kids clothing, that they grow out of before they can ware them out. Why can't the government just check for lead before they go on sale for the first time. This way they only have to check one or two items in a batch of thousands. Instead their making each person that buys that item have it checked before it can be resold, to make what three dollars on a item that cost twenty. why should we pay for the governments lack of testing and weak importing guide lines.

As for the things we already own and want to sell then the government should have been doing their job years ago by conducting test on imported goods. if it was deemed good enough by the government to be in this country for my daughter then, why is it not good enough for someone else's.

I think this new law is utterly stupid! Look what will happen to the landfills with prefectly good items b/c they cannot be resold. Not counting all of the little shops they are forcing out of business. There are people now that will not be able to afford to buy for their children stupid!!

The law makers of america need to rethink these bills and FAST!!!

I sell all my daughters outgrown clothes & toys on-line, and also take them to consignment shops, I also buy almost all of her clothes from consignment shops. But I guess not anymore.

With the economy as it is congress needs to chalk this up to an oops. Even if we weren't having the problems we are now this was knee jerk legislation.

Is there an email address or *gulp* postal address we can voice our concerns at?

Sorry for the Blog Appearance, I was unaware that this was posted. I was trying to post the Adult Story and they went to automatic Approval Mode. Which is why it is posted under my 2nd I.D. Since it's featured I can't change it so as to read it easier... again I apologize.

The Best Place to call to Complain would be your Reps in Congress. Ring their phones off the Hook and ask why they snuck this through last year during the election....it was written in January of 08 and wasn't passed until July...and yet no one noticed till now.

The above is exactly why this law was put into place ... nothing to do with lead, everything to do with shock tactic, sleazy reporting. Fact is that most of the recent items found with lead weren't 'filled with lead', rather they contained very small amounts of lead. But, it happens to be above what is considered safe. Since the media whipped the general populous into a frenzy, law makers have to do something that looks like their addressing the problem. Hence some do nothing law that has a negative impact, not on the perceived problem, but on the general population.

The problem is that we don't really know what a safe level of lead is, so, the government uses some ridiculously low number as their safe level. Anecdotal evidence shows that this number is ridiculously low. It was in the 60's when they banned lead in paint, and up until that time, virtually all paint contained lead. This means that not only were houses painted with lead based paint, most toys where made from lead based painted metal or wood. Even some toys were made of lead, or actual lead in them. Lead was a very commonly used material at that time. So, if lead exposure were such a problem, wouldn't all of us baby boomers (post WW II era) and older have seen all the devastating effects? We haven't, therefor, I submit that minute contact with lead doesn't pose a major health risk.
